Native People and Holy Mountains
Jun 1st, 2009 by thethirdwave
Hello,
This is my first podcast. I decided to try podcasting after my blog, The Third Wave, became inactive. Hopefully this new format will open up some new sources of discussion. If you like my podcast, please subscribe, and post your comments in the area below! I want the podcast to be the beginning of a discussion, so comments are essential.
Thanks!
In this podcast, I discuss the case of a coalition of Native American tribes and environmentalists who are attempting to stop the use of artificial snow on their holy mountains. The United States Forest Service decided to use wastewater from Sacramento in order to create artificial snow on the San Francisco peaks, mountains that are sacred to Native Americans in the area. The Native Americans sued. They lost both the case in district court and at the appellate level.
“Title: Navajo Nation, et al. v. United States Forest Service, et al. Issue: Whether a governmental action cannot constitute a “substantial burden” under RFRA unless it forces individuals to choose between following the tenets of their religion and receiving a governmental benefit or coerces them by threatening civil or criminal sanctions to act contrary to their religious beliefs.” ~http://www.scotusblog.com/wp/petitions-to-watch-conference-of-6409/
